FMCSA Takes Emergency Action on Key CVTA Priority

1 min read

FMCSA recently asked the Office of Management and Budget (OMB) for emergency approval of a new information collection, "Strengthening the Standards for Initial Listing on the Training Provider Registry." If approved, FMCSA would review a training provider's documentation before listing it on the TPR. Since 2022, providers have used the self-certification alone.

What FMCSA will be able to see.

Every new applicant, and every listed provider adding a location, would submit:

  • Lesson plans for theory and behind-the-wheel training, both range and public road

  • Vehicle documentation showing training trucks match the class and type students will test in

  • Instructor files with driving and training experience, plus copies of each instructor's CDL and endorsements

  • State authorization, licensure, etc., for every state where the provider trains in person

  • Facility documentation for any in-person training site under 49 CFR 380.709

CVTA joins FMCSA in welcoming this critical step to end the 'self-certification' structure of the Training Provider Registry that CVTA's ELDT Task Force has advocated for since 2022.

 What's next

  • OIRA review. As of October 14, the request is still listed as received and under review at OIRA.

  • Public comment. If it's approved, FMCSA will publish a 60-day comment notice in the Federal Register within 90 days.

  • Permanent rule. FMCSA will propose permanent registry standards through RIN 2126-AD00.

FMCSA's filing notes that current rules already require providers on the registry to keep lesson plans, instructor qualification records, and state licensure documentation. Schools adding a location should expect to submit those records, along with vehicle and facility documentation.
